Temporary or Occasional Use Notices

Temporary Use Notices (TUNs)

Temporary Use Notices allow a licensed gambling operator to provide infrequent gambling activities at a premises without needing a premises licence. Suitable venues include hotels, conference centres and sporting venues.

Under the regulations, the only gambling activity permitted under a TUN is equal chance gaming arranged as a tournament with a single overall winner.

A premises may not be used for gambling under TUNs for more than 21 days in any 12-month period. Notices can only be given by a person or organisation that holds a relevant operating licence issued by the Gambling Commission.

Occasional Use Notices (OUNs)

Premises intending to provide track betting facilities for no more than eight days in any calendar year may use an Occasional Use Notice instead of a full premises licence. A ‘day’ runs from midnight to midnight.

A ‘track’ is a racecourse, sports ground, or any location where a race or sporting event is due to take place (including point-to-point races).

An OUN must be served by a person responsible for administering events on the track or by an occupier of the track. The person giving the notice must ensure that only licensed operators (with betting operating licences issued by the Gambling Commission) accept bets on the day of the event.

An OUN cannot be issued if a gambling premises licence is already in place for the premises.

The notice must be given in writing to Colchester City Council and Essex Police before the event starts.

There is no provision for objections to an OUN. Provided the venue has not exceeded the limit on days and the form is correctly completed, the OUN will be approved.
