Sex Shops and Sexual Entertainment Venues

Sex Establishments are defined by schedule 2 of the Local Government (Miscellaneous Provisions) Act 1982. Sex Establishments are sex shops, sex cinemas and sexual entertainment venues.

A sex shop  

  • is a category of sex establishment that provides sex toys, books, restricted 18 films or other articles defined as sex articles under the Local Government (Miscellaneous Provisions) Act 1982.
  • that sells, hires, exchanges, lends, displays or demonstrates sex articles to a significant degree is required under the Act to be licensed.
  • a sex shop can be a stall or vessel as well as a shop premises.

 

A sexual entertainment venue

  • is a category of sex establishment that provides relevant entertainment before a live audience for the financial gain of the organiser of the event.
  • relevant entertainment is any live performance or display of nudity which is of such nature that, ignoring financial gain, it must reasonably be assumed to be provided solely or principally for the purpose of sexual stimulating any member of an audience
  • relevant entertainment includes lap dancing, pole dancing, table dancing, strip shows, peep shows and live sex shows. 


Part 2 of the Local Government (Miscellaneous Provisions) Act 1982 creates a regulatory licensing regime for sex establishments.  Schedule 3 of the Act sets of the sex establishment licensing regime.  Schedule 3 was amended by the Policing and Crime Act 2009 and this created sexual entertainment venues as a new category of sex establishment.

The Council's pdf icon Sexual Establishment Policy [228kb] sets out the Council's proposed approach to regulating sex establishments and the procedures it will adopt in relation to applications for sex establishment licences.  The Council has a single application form and process for new, renewal, variation and transfer applications.  A shortened form can be used for renewal applications in the event that nothing in respect of the licence has changed.
